Removal of categories of rights and geographical areas from Teosto’s administration: assurances

Assurance about extended collective licence

If the use right granted by Teosto includes an extended collective licence, as referred to in section 26 of the copyright act, the member is considered to have denied the use of works in the removed categories of rights and areas, on the basis of the extended collective licence, in situations where the rightholder has the right, based on law, for such a denial.

Assurance about the rights belonging to other members

I understand that removing categories of rights or geographical areas from Teosto’s administration does not exempt my works from the rights that are dictated by law or agreement and that Teosto administers by the authorisation of its other members, and that this removal might require consent from other Teosto members.

I understand that if I transfer the administration of the categories of rights or geographical areas I have removed to an organisation practising collective management of copyrights, which fulfils the requirements of reliable rights administration, separate consent from other Teosto members is not needed according to the decision of Teosto’s Board of Directors. I am aware which organisations practising collective management have been confirmed by Teosto’s Board of Directors to fulfil the requirements for reliable rights administration.

I confirm that I understand that if I am not transferring the categories of rights or geographical areas I have removed to be administered by an organisation practising collective management and fulfilling the requirements for reliable rights administration, the removal might require consent from each music publisher or author of a joint work who is a Teosto member and holds rights administered by Teosto associated with my works.

I understand that the removal of categories of rights and geographical areas can enter into force without the consents, but in such an event other holders of rights associated with my works might present claims for remuneration or other similar claims to me.
